UTAH – Stop a Big Tobacco Protection Act!

A bill (SB 61) known to advocates as “PMTA Registry” legislation has been through the Utah Senate and sent to the House Rules Committee. SB 61 was amended along the way to include a ban on flavors other than mint, menthol, or tobacco in vapor products and includes an unscientific limit on nicotine concentration at 4% (40 mg/mL).

**Utah’s legislative session ended on March 1, 2024 and, as expected, SB 61 moved at lightning pace to passage by the house and senate**

  • Starting on January 1, 2025 the sale of flavored nicotine vapor products will be prohibited. It will also be unlawful to sell any e-cigarette product that has not received premarket authorization or has an application pending with FDA.
  • Jan. 1, 2025 is also the deadline for any synthetic nicotine products to come off the markdet that have not recieved marketing granted orders. While products with applications pending with FDA as of Sept. 9, 2020 will still be allowed for sale, synthetic nicotine products that met the 2022 application deadline imposed by congress will need to recieve FDA authorization in order to be marketed in Utah. 
  • Tell your lawmakers that HB 61 is more about protecting Big Tobacco profits than improving public health and share your personal story about switching to vaping.
  • SB 61 will close down hundreds of small businesses and put hundreds of workers out of a job.
  • The state doesn’t need to carry water for the FDA by enforcing its disastrous anti-vaping regulations.
  • FDA has arbitrarily denied marketing orders for nearly 1 million products and is failing to move forward with authorizing others.
  • If HB 61 is enacted, consumers will only have access to a handful of products that have applications pending, or are authorized by FDA.
