STOP A FEDERAL TAX!
Comparing “oranges to oranges” (in this case milligrams of nicotine in vapes vs cigarettes,) if HR 5715 is enacted, vapes would be taxed at a rate approximately 5X higher than cigarettes! Vaping consumers will be paying up to 6¢/mg of nicotine compared to 1.1¢/mg in cigarettes.
The tax hike is just as bad, if not worse, for nicotine pouches, snus, and moist snuff — all reduced risk products compared to cigarettes!

MICHIGAN
STOP an onslaught of anti-vaping bills!
Lawmakers in Michigan are once again throwing everything and the kitchen sink into a raft of anti-vaping bills aiming to reduce everyone’s access to these life-saving products! These bills include everything from a flavor ban and tax hikes to repealing state preemption of local tobacco retailer laws.

FLORIDA
These so-called “PMTA Registry Bills” are currently making their way around the U.S. They make it far more difficult for companies awaiting PMTA to sell life-saving products and ban thousands of products popular with adults.

OHIO

VIRGINIA
If enacted, this law would effectively ban all vaping products not granted marketing orders through FDA’s “arbitrary and capricious” authorization process (over 99%) and “call for a fine of $1,000 a day for each product sold.”

WASHINGTON
Bill SB 6118 (aka “PMTA Registry”) legislation has been introduced and referred to the Senate Labor and Commerce Committee. No hearing is scheduled at this time, but we expect this bill to move quickly!

VERMONT
A flavor ban bill (S. 18) has already passed the Senate.
UPDATE! Hearings are already happening in the House and, disturbingly, are being hastily scheduled with little to no opportunity given for public comment!

Yet another state is trying to pass a “Big Tobacco Protection” act!
Anti vaping bill SB 227 (aka “PMTA Registry legislation”) has been introduced and is scheduled for a hearing on TUESDAY, January 23, 2024!

Researcher Bias Endangers Public Health
By strongly encouraging “anyone who uses e-cigarettes or vapes to quit” without cautioning that smoking is significantly worse, Dr. Rezaee of the Cleveland Clinic is endangering public health by discouraging people who smoke from choosing safer alternatives.

WHO Refuses to Acknowledge Continuum of Risk
The World Health Organization is disingenuously claiming that nicotine vaping is as harmful as smoking cigarettes because they contain (very low) levels of (some) toxins that are also found in cigarettes.
That’s like saying a 2024 car is as unsafe as a 1924 car because they both have wheels and engines, while ignoring the advanced framing, head lights, turn signals, mirrors, safety glass, head rests, traction control, seat belts and air bags in 2024 cars.

Nicotine in e-Cigarettes Not “More Addictive” Than Cigarettes
This new study found that nicotine salt e-cigs delivered nicotine to the brain better than free-base e-cigs, but both are less efficient than cigarette smoking.
This contradicts previous baseless speculation that vaping is “more addictive” than smoking simply due to the nicotine content of a pod/cartridge.

FDA Denies PMTAs for 22 SMOK Devices, Pods and Coils
With anti-THR orgs screaming about “youth-friendly,” “litter-generating” disposables, the FDA has banned 6 refillable SMOK vaping devices that are not popular with youth, do not contain any tobacco or nicotine, and have less impact on the environment.

SMOK Appeals FDA Denial in Fifth Circuit Court
A vaping product manufacturer and a Texas vape distributor have filed a petition in the Fifth Circuit Court of Appeals for review of the FDA marketing denial orders (MDOs) issued earlier this week for 22 hardware products.
