Two companion bills (A7814 / S8092) that would prohibit discounts or other rewards that incentivise purchasing low-risk nicotine pouches are working their way through the New York legislature. These bills specifically target nicotine pouches by adding them to the existing prohibition on discounts for other nicotine and tobacco products.
Supporters of these bills claim this action is necessary to prevent youth use of nicotine. But youth use of any nicotine product is at an historic 25-year low. Like other policies targeting safer nicotine products, this bill is a solution in search of a problem and risks delaying or discouraging people from quitting smoking.
A7814 is moving toward a floor vote in the Assembly and S8092, assigned to the Senate Health Committee, is still waiting for a hearing.
TAKE ACTION by sending messages to your New York lawmakers urging them to oppose this bill. People who smoke deserve to know that smoke-free products like nicotine pouches are safer than smoking and keeping them more affordable than cigarettes is vital to encouraging people to switch to low-risk products.
- Allowing discounts and rewards for nicotine pouches incentivizes people to choose low-risk products and quit smoking.
- Making low-risk nicotine products less competitive with cigarettes discourages people from switching to safer alternatives.
- FDA has already authorized nicotine pouches under the “appropriate for the protection of public health standard.”
